Legislative Initiatives:
 
Summary of Legislation sponsored by Rep. Debra Maggart and enacted into law during the 106th General Assembly. 


Sex offenders:  Protecting our children has been my number one priority during my service as your State Representative.  Tennessee was at one time a magnet for sex offenders but I have worked hard to strengthen our laws to protect our children from sexual predators.

  •  Public Chapter 414 (HB0619) Evidence - For years, sex offenders have walked because oftentimes parents of children who have been abused are reluctant to prosecute the offender and put their child through a trial.  Now, the child’s testimony after the alleged abuse may be videotaped by a forensic interviewer and submitted in the trial as evidence thus sparing the child the agony of facing his or her abuser in a court of law. 

 

  • Public Chapter 414 (HB0620) Sexual Offenses - As enacted, redefines "indecent exposure" to include knowingly engaging in the person's own residence certain conduct in the presence of a child for the purpose of sexual arousal or gratification.

 

  • Public Chapter 115 (HB0623) Criminal Procedure - As enacted, establishes the venue for a violation of community supervision for life of a sexual offender as the county where the offender was being supervised at time of violation and permits probation officer to be affiant for purposes of obtaining affidavit of complaint against person.

 

  • Public Chapter 145 (HB1820) Tennessee Bureau of Investigation - As enacted, permits bureau to digitize sex offender files and provides that a digitized copy of original is same as an original for all purposes, including introduction into evidence in a judicial or administrative proceeding.

 

  • Public Chapter 860 (HB2438) Juvenile Offenders - As enacted, adds aggravated rape of a child to the list of offenses for which a juvenile may be transferred from juvenile court to adult court.

 

  • Public Chapter  XXX (HB3277)Criminal Offenses - As introduced, deletes the requirement that a person being photographed must be readily identifiable in order for the offense of unlawful photographing to be committed.

 

  •  Public Chapter 904 (HB3369) Sexual Offenders - As enacted, establishes procedures for revocation of license to practice medicine or other restrictions on practice if licensee found to be, after hearing, a person required to register as a sex offender.


 

  • Public Chapter XXX (HB2788) Sexual Offenders - As introduced rewrites various provisions of the Sexual Offender and Violent Sexual Offender Registration, Verification and Tracking Act of 2004.
